This agreement is between First Net Web, Incorporated ( hereinafter called "First Net Web") and the account holder (hereinafter called "You or Your") of First Net Web services. It applies to the person or persons making the purchase as well as their heirs, agents, and contractors and is effective at the time of service enrollment, payment or use. Enrollment in, payment for, or use of services is an acknowledgement that this agreement has been read and understood. If you do not agree to these terms and conditions, please notify First Net Web at support@nons.net to initiate account termination. Use of Your account shall constitute Your approval. This agreement represents the complete agreement and understanding between First Net Web and You and supersedes any other written or oral agreement. Upon notice published online via First Net Web services, First Net Web may modify these terms and conditions, modify prices, and discontinue or change services offered. First Net Web makes no warranties of any kind, whether expressed or implied, for the service it is providing. First Net Web also disclaims any warranty of merchantability or fitness for a particular purpose.

1. First Net Web requires that its agreements be made with a person who is qualified to contract. As such, subscriber must be over the age of eighteen (18) years. Otherwise, a parent or guardian must accept this agreement and enclose the proper payment. First Net Web cannot accept payments or agreements from persons who are not at least eighteen (18) years of age.
   
   
2. You agree to pay First Net Web at the time service is provided. Payment is to be made by credit card, PayPal, or check, and is non-refundable. If for any reason First Net Web is unable to charge Your credit card or PayPal account with the full amount owed, or if First Net Web is charged back for any amounts charged to the credit card or PayPal account, First Net Web may pursue all available remedies for payment. If a check does not clear Your account, First Net Web will charge a $50 check handling fee in addition to pursuing all available remedies for payment. Accounts which are in arrears shall be suspended until appropriate payment has been made.
   
   
3. We reserve the right to review, at our own discretion, materials written, sent, stored, or otherwise processed under Your account. Transmission or publication of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material. First Net Web reserves the right to remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement.
   
   
4. You shall ensure that Your use of First Net Web's network services shall not disrupt First Net Web, its associated networks or any equipment forming part of its systems. In instances in which an excessive amount of system resources are utilized by a subscriber, First Net Web reserves the right to place CPU process limits on Your account to prevent disruption of service to other customers. You shall not transmit any communication where the meaning of the message, or its transmission or distribution, would violate any applicable law or regulation or would likely be offensive to the recipient thereof. No message may be mass distributed, broadcast, or otherwise sent on an intrusive basis to any First Net Web user or to any directly or indirectly attached network. Use of First Net Web's connection in a manner that is disruptive, damaging, unlawful, offensive, or intrusive as determined by First Net Web shall be considered a breach of this Policy and may result in cancellation of service. This prohibition extends to sending of unsolicited mass mailings from another service which in any way implicates the use of First Net Web's service, First Net Web's equipment or any site hosted on any First Net Web network.
   
   
5. First Net Web reserves the right to terminate an account at any time, for any reason and without notice. In case of cancellation, unused fees may be returned to the subscriber on a prorated basis. Fees for setup and the first month's service are not refundable.
   
   
6. Your account records should be accurate and current. You are responsible for maintaining the confidentiality of Your password and account information. You also assume sole responsibility for all activities that occur under Your account. First Net Web accounts cannot be transferred or used by anyone other than the subscriber. You may not sell, lease, rent or assign the connection or parts of the connection to any party not named in this Policy.
   
   
7. Use of First Net Web's hosting services could involve listing subscriber's participation in relevant directories, and You expressly grant permission for such listings.
   
   
8. On occasion, First Net Web may have a need to communicate with its customers through email issues related to billing, as well as changes, additions and modifications to the network. You are responsible for checking email sent to the primary login email address on the account. Failure to receive or read the email shall not constitute reason to challenge the service modification.
   
   
9. Transferring Your domain to another provider does not constitute canceling Your First Net Web account. You must notify First Net Web to formally cancel Your account and to avoid further charges.
   
   
10. First Net Web will not be responsible for damages You suffer. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence, subscriber's errors or omissions, or due to the fault of third parties. You agree that First Net Web will not be liable for any loss that You incur as a result of unauthorized access to Your account. You agree that First Net Web will not be liable for any losses, damages or costs, including reasonable attorney's fees, resulting from any claim, action, proceeding, suit or demand arising out of or related in any way to Your account with First Net Web. You agree to defend, hold harmless and expeditiously indemnify First Net Web from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in this Policy and resulting from Your use of the service.
    
    
11. You may cancel any and all services at any time by e-mailing First Net Web at support@nons.net. After verifying that You are the authorized account owner, all services and billing will terminate at the end of the current billing cycle. You are responsible for backing up, or making copies, of all files associated with the services You were using; First Net Web will not be responsible for recovering any files purged after services are terminated.
